Belvidere Park District ADA Grievance Procedure

The BPD is committed to providing equal access for all and strives to make reasonable accommodation for individuals whose disabilities are consistent with the requirements under the ADA.  This grievance procedure is established to promptly address complaints alleging discrimination based on a disability in the provision of services, programs, activities, employment practices, or benefits by the Belvidere Park District.  If a person (including district employees) feels their rights under the ADA have been violated by the district, they may file a complaint against the Belvidere Township Park District.

Making a Complaint and ADA Coordinator

An ADA Grievance complaint shall be filed via electronic form submission or in writing to the district’s ADA Coordinator.  Complaint must include the following information: complainant’s name, address, phone number, and email address (if available); a brief description of complaint – including the location, date, and time of any incident; and the requested or suggested solution.  Reasonable accommodation will be provided for persons with disabilities who are unable to submit a written or electronic complaint through personal interview or audio recording of the complaint.

File a Grievance Complaint

 

The complaint should be submitted by the grievant and/or their designated representative as soon as possible, but no later than 60 calendar days after the alleged violation.  All complaints will be forwarded to the Belvidere Township Park District’s ADA Coordinator:

Investigating the Complaint

The ADA Coordinator will investigate the complaint and might request a meeting to obtain and consider additional information or discuss possible solutions from the complainant within 15 calendar days after the receipt of original complaint.  The complainant’s failure to respond to the request for additional information will deem the request abandoned.

Resolution of Grievance


Within 15 calendar days of the meeting or request for additional information, the ADA Coordinator will respond in writing (or requested accessible format) to the complainant.  The response will detail the position of the Belvidere Township Park District and offer substantive resolution of the complaint.

Reconsideration

If the district’s response is not satisfactory, the complainant may appeal the decision for reconsideration within 15 days of receipt of resolution.  The appeal should be submitted in writing and filed with the Belvidere Township Park District, Executive Director, 1006 W Lincoln Ave, Belvidere, IL, 61008.  Additionally, it should include, in detail, reasons the complainant believes the findings to be in error.  The Executive Director will respond in writing within 20 days of the date the appeal was submitted, with a final resolution to the appeal.

If the appeal is unsatisfactory, the complainant may file a complaint with the appropriate agency or department of the State or Federal government.

Complaint/Records Retention

All written complaints received by the ADA Coordinator, appeals submitted to the Executive Director, and responses to complainants will be kept on file by the Belvidere Township Park District for 3 years or until stated in the records retention schedule adopted by the district, whichever is longer.
